Trace Reservation Agreement

February 4th, 2007 · 2 Comments

Is it me or does the Trace Reservation Agreement [pdf] discriminate against single people?

Buyer may hold only one first priority purchase reservation at a time.

I had been considering making two first priority reservations but it looks like the reservation agreement precludes this. Though if you’re a couple presumably you can hold two first priority reservations since you’re executing the agreements under different names.

Well, if you want two priority reservations you would have had to make two reservation appointments.

    BTW,

Rachel and I decided on our very short stack.

    201
    then maybe 304

Good luck with your reservation appt today.

Probably not. The term “buyer” may be inclusive of the buying party named in the purchase and sale agreement, but it’ll depend on Trace’s definition. Though, if a couple will hold property individually, then perhaps they could very well have two priority reservations. The Assignment clause precludes assigning the reservation.
