Brix Contractor Speaks Out About Liens

A disgruntled Brix contractor speaks out in the comments.

TODAY (MARCH 5, 2009) I AM FILING A NEW LIEN AND I AM OWED THE MONIES NOTED ABOVE BUT, I am only going after the retention.

Update: I have a call into the contractor who left the comment and I spoke to a representative from Schnitzer West, the Brix developer, about this issue. Schnitzer West does’t want liens any more than anyone else and is working through these issues. There’s also some magic they do in terms of bonds and insurance to insure that the titles for the individual units are free and clear. I have to admit I don’t fully understand the situation and don’t have the time to dig into it today so you should consult with your real estate agent or a real estate lawyer if you’re looking at a project with liens (Brix isn’t the only one) about the impact to you.

So how many units aren't vacant? The building looks pretty dark every time I pass by. Vivace is always busy though.

I'm sorry that this contractor thinks they should be getting paid more $ but I think they're barking up the wrong tree if they think a condo buyer is realistically going to factor their dispute into a purchase decision.

Would I be surprised to learn that the developer is screwing over a sub? No. But am I supposed to worry about whether every last sub got paid properly before I buy somewhere on top of all my other purchase considerations? Imagine.

Gosh, this is a nice building, I really love the neighborhood and the location, I love the design and the views, this place would be perfect! Oh wait, never mind. The drywall installer didn't get paid what they thought they were owed. Oh well, I guess I'll keep looking around.

Sabzi – in theory I think you are right. However, once notice of lien is posted, any subsequent purchaser would be buying subject to that lien. In other words, if the developer doesn't/can't pay and a court find in favor of the contractor/sub-contractor, a purchaser with notice of the lien could be forced to fork over $$$$. Purchasers prior to the lien are protected. I believe this is how it works and why a purchaser might be 'scared' away.

I am the sub contractor who started this string. Schnitzer / Brix LLC has settled the lien. I have been paid up for what they owed me and they made it right.
